By downloading, installing, or using the BLES mobile application or website (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BLES is a fitness platform that provides workout tracking, nutrition logging, progress monitoring, and AI-powered coaching. The Service is provided on an "as is" and "as available" basis. Features may change, be updated, or be discontinued at our discretion.

3. User Accounts

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Beta Program

If you are participating in the BLES beta program (via TestFlight or Android early access):

  • The Service may contain bugs, errors, or incomplete features.
  • Beta features may be modified or removed without notice.
  • Your feedback may be used to improve the Service without compensation.
  • Beta access perks (e.g., "Premium Free for Life") are subject to the terms communicated at the time of enrollment and may have reasonable usage limits.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Upload malicious code, spam, or harmful content.
  • Harass, abuse, or harm other users.
  • Scrape, crawl, or use automated means to access the Service without permission.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Impersonate another person or entity.

6. Health and Fitness Disclaimer

BLES is not a medical service. The Service provides fitness and nutrition information for general educational and informational purposes only. It is not intended as a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare provider before starting any exercise or nutrition program.
  • AI-powered recommendations are algorithmically generated and may not be appropriate for your specific health conditions.
  • Macro calculations, calorie estimates, and workout suggestions are approximations and should not be relied upon as medical advice.
  • You use the Service at your own risk and assume full responsibility for your health and fitness decisions.

7. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, images, software, and the BLES brand — are owned by BLES and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content you create (workout logs, photos, etc.) but grant BLES a non-exclusive, royalty-free license to use anonymized, aggregated data to improve the Service.

8. User-Generated Content

If you post content through community features (comments, shared workouts, challenge participation), you:

  • Retain ownership of your content.
  • Grant BLES a license to display, distribute, and promote your content within the Service.
  • Are solely responsible for the content you post.
  • Agree not to post content that is illegal, offensive, or violates others' rights.

We reserve the right to remove content that violates these Terms.

9. Third-Party Services

The Service may integrate with third-party services (Apple Health, Google Fit, food databases, payment processors). Your use of these services is governed by their respective terms and privacy policies. BLES is not responsible for third-party service availability or practices.

10. Limitation of Liability

To the maximum extent permitted by law:

  • BLES shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • BLES shall not be liable for any loss of data, profits, or goodwill.
  • BLES shall not be liable for any personal injury or health consequences resulting from your use of the Service.
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold BLES, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service ceases immediately.
  • You may request a copy of your data within 30 days of termination.
  • We may delete your data after 30 days following termination.

You may delete your account at any time through the app settings or by contacting us.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
